Kullanıcı Yükümlülükleri ve Yasaklı Fiiller
Kullanıcı, Hizmet ve bünyesindeki modüller (Oathnet Lookup, Snusbase Lookup, IntelVault, Discord OSINT, Getcontact, WhatsApp / Fake No, OsintCat, Memory.lol, CraftRise OSINT, HackCheck, LeakOsint, OsintKit vb.) aracılığıyla eriştiği bilgi ve içerikleri; taciz veya takip, kimlik hırsızlığı, yetkisiz erişim, şantaj, dolandırıcılık, ayrımcılık, spam, verinin yeniden satışı, çocukların istismarı ve terörizm dâhil hiçbir hukuka aykırı amaçla kullanamaz.
Kullanıcı özellikle; elde ettiği hiçbir bilgiyi TCK m.135-136, m.243, m.244 ve m.245 kapsamında bir suçun işlenmesinde veya Anayasa m.20 ile korunan özel hayatın gizliliğini ihlal edecek şekilde kullanmayacağını kabul, beyan ve taahhüt eder.
11.
Sorumluluğun Reddi ve Tazmin Yükümlülüğü
Hizmet "OLDUĞU GİBİ" sunulur. Platform yönetimi, geliştiricileri ve operatörleri; kullanıcıların kendi sorgularından ve fiillerinden doğacak hiçbir hukuki, cezai veya idari sorumluluğu üstlenmez.
Kullanıcı, 256-bit erişim anahtarını (`X-****************`) kullanarak gerçekleştirdiği her eylemden şahsen ve münhasıran sorumludur. Kullanıcı, Hizmet'i hukuka aykırı kullanımından kaynaklanan her türlü üçüncü kişi taleplerine, davalara ve idari/adli yaptırımlara karşı SearcherX'i tazmin etmeyi (ari tutmayı) kabul eder.
12.
Yasal Uyumluluk (Kullanıcının Kendi Yargı Çevresi)
Kullanıcı, bulunduğu ülkenin ve tabi olduğu yargı çevresinin yürürlükteki tüm siber güvenlik ve veri koruma mevzuatına uymakla yükümlüdür. Bir yargı alanında yasak olan bir kullanım, o kullanıcı bakımından da yasaktır ve bunun sorumluluğu tamamen kullanıcıya aittir.
13.
İhlal Hâlinde Yaptırımlar
Platform yönetimi; işbu metne veya yürürlükteki mevzuata aykırı davranan, sistem güvenliğini tehdit eden veya cihaz kilidini suistimal eden kullanıcıların erişim anahtarını (`X-****************`) hiçbir ücret iadesi yapmaksızın derhal kapatma, askıya alma ve ağır suç teşkil eden hâllerde ilgili adli mercilere bildirme hakkını saklı tutar.
14.
Yetkili Makamlarla İşbirliği
SearcherX yasal çerçevede faaliyet gösterir; yetkili makamlarla işbirliği geçerli ve bağlayıcı bir yasal süreçle sınırlıdır:
- Geçerli mahkeme kararı, Cumhuriyet Savcılığı talebi, arama/el koyma kararı, MLAT ve eşdeğer bağlayıcı yasal süreçlere yanıt verir ve saklama süresi içinde elimizde bulunması hâlinde talep edilen sınırlı teknik kaydı paylaşır.
- Yakın ölüm, çocuk istismarı veya ciddi fiziksel zarar riski içeren acil durumlarda, iyi niyet temelinde bilgi paylaşabilir.
- Yasal muhafaza emirlerine uyar; aşırı geniş, keşif amaçlı veya mevzuata uygun olmayan talepleri reddeder veya itiraz eder.
Kolluk ve düzenleyici kurum talepleri yalnızca `[email protected]` adresine iletilmelidir.
15.
Uluslararası Veri Koruma Mevzuatı (GDPR · UK GDPR · CCPA/CPRA)
Platform dünya genelindeki kullanıcılara hizmet verir ve KVKK'nın yanı sıra ilgili uluslararası mevzuata da uyum sağlar:
- GDPR (AB 2016/679) — AB/AEA kullanıcıları için işleme hukuki sebepleri (m.6) ve veri sahibi hakları (m.15–22: erişim, düzeltme, silinme/unutulma, taşınabilirlik, itiraz) uygulanır.
- UK GDPR & Data Protection Act 2018 — Birleşik Krallık kullanıcıları için.
- CCPA / CPRA (Kaliforniya) — Bilme, silme ve satışa itiraz hakları; kullanıcı verilerini asla satmıyoruz.

16.
Uluslararası Siber Suç Mevzuatı ve Bölünebilirlik
Kullanıcı, yalnızca Türk hukukuna değil tabi olduğu ülkenin siber suç ve veri koruma mevzuatına da (Avrupa Konseyi Budapeşte Siber Suç Sözleşmesi, ABD CFAA, Birleşik Krallık Computer Misuse Act 1990 ve AB siber güvenlik direktifleri dâhil) uymakla yükümlüdür. İşbu metnin herhangi bir hükmünün herhangi bir yargı çevresinde geçersiz veya uygulanamaz olması, diğer hükümlerin geçerliliğini etkilemez.

Açık Rıza, Aydınlatma ve Kabul Beyanı
Platform'da tek tıkla 256-bit Kalıcı Erişim Anahtarınızı (`X-****************`) oluşturarak veya onay kutusunu işaretleyerek aşağıdaki beyanda bulunmuş olursunuz:

SearcherX is an Open Source Intelligence (OSINT) indexing and search correlation engine that compiles, aggregates, and correlates data made publicly available across open internet repositories, data breach records, and third-party threat feeds.
The platform integrates various external query modules including Oathnet Lookup, Snusbase Lookup, IntelVault, Discord OSINT, Getcontact, WhatsApp / Fake No, OsintCat, Memory.lol, CraftRise OSINT, HackCheck, LeakOsint, OsintKit, and related engines.
- The Platform is not the original creator, source, publisher, or host of indexed records; we do not produce third-party personal data.
- The Platform does not claim ownership or store underlying breach files permanently; it provides high-speed API bridge search capabilities over existing repositories.
- We strictly enforce a "Notice-and-Takedown" principle: unlawful records or infringing identifiers formally reported via [email protected] are promptly filtered and removed from search interfaces.
- The Platform maintains no editorial control over the accuracy, completeness, or freshness of data returned from external engines.
The Service is strictly dedicated to legitimate cybersecurity auditing, personal breach verification, authorized penetration testing, DFIR investigations, academic research, and lawful investigative purposes.

Processed Personal Data and "Instant Anonymous Access" Architecture
SearcherX operates on privacy-by-design and minimal data collection principles:
- 256-Bit Persistent Access Keys (`X-****************`): No email, password, phone, or name is required during registration. The cryptographic hash of your generated key is your sole identifier.
- Device Lock Verification Signature: Cryptographic hardware/browser fingerprint ensuring your key is bound exclusively to your authorized terminal.
- Query & Rate Limit Metadata: Counter metrics, quota consumption, anti-abuse logs, and fraud prevention timestamps.
- Session Telemetry: IP address, user-agent string, and timestamp records.
- Payment Verification Data: Blockchain transaction IDs (TXID) for cryptocurrency, or payment reference IDs for bank wire / card processors.

Purposes of Processing Personal Data
Personal data is processed solely for the following legitimate purposes:
- Delivering seamless OSINT lookup infrastructure and account authentication.
- Ensuring technical infrastructure security, mitigating DDoS attacks, preventing unauthorized automated scraping, and stopping credential abuse.
- Maintaining ledger records for quota management, balance refills, and referral reward credits.
- Complying with mandatory legal obligations and responding to binding court orders.
5.
Legal Grounds for Processing (KVKK Art. 5-6 & GDPR Art. 6)
Personal data is processed under the following lawful bases:
- Establishment and performance of the Service Agreement (KVKK Art. 5/2-c, GDPR Art. 6/1-b).
- Legitimate interests of the Platform in preventing fraud, enforcing rate limits, and securing systems (KVKK Art. 5/2-f, GDPR Art. 6/1-f).

Data Transfers and Cross-Border Sharing (KVKK Art. 8-9 & GDPR Chapter V)
SearcherX enforces strict zero-commercialization data policies:
- Personal data is NEVER sold, rented, or commercialized to third parties, advertising brokers, or data brokers.
- Queries are routed via encrypted reverse proxies directly to technical module endpoints solely to retrieve requested results.
- Infrastructure servers are located in high-security, GDPR-compliant cloud facilities with TLS 1.3 in-transit and AES-256 at-rest encryption.
7.
Data Retention Periods
- Session telemetry and operational access logs are purged on a rolling 30-day schedule.
- Account balances and 256-bit cryptographic key hashes are retained until the account is deleted.
- When account deletion is initiated, a 24-hour safety buffer applies, after which all account records, device tokens, and balances are permanently destroyed.

Data Subject Rights (KVKK Art. 11 & GDPR Art. 15-22)
As a data subject, you hold the legal right to:
- Learn whether your personal data is being processed, and request details thereof.
- Request the rectification of incomplete or inaccurate records.
- Request the erasure, destruction, or anonymization of your data.
- Object to the processing of personal data on legitimate grounds.
- Request that your identifiers or leaked records be blacklisted/whitelisted from lookup outputs via [email protected].
9.
Applicable Legal Framework and Governing Law
This Agreement and Platform operations are governed by universal principles of private law and applicable data protection frameworks. In the event of cross-border inquiries, internationally accepted conflict of laws and cybersecurity norms apply.
10.
User Obligations and Prohibited Activities
Users expressly warrant and covenant that:
- The Service shall NEVER be used for unlawful stalking, harassment, extortion, identity theft, unauthorized account takeovers, or illegal surveillance.
- Queries shall be grounded in legitimate cybersecurity, personal defense, or authorized audit grounds.
- Circumventing rate limits, exploiting vulnerabilities, or unauthorized bot automation is strictly prohibited.
11.
Disclaimer of Warranties and Indemnification
YASAL UYARI: SearcherX provides its services on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. SearcherX disclaims all liability for third-party breach inaccuracies. The user agrees to fully indemnify and hold harmless SearcherX and its operators against any third-party claims arising from unauthorized target lookups.
12.
Jurisdictional Compliance
The user is solely responsible for verifying the legality of open-source intelligence research under the domestic laws of their country of citizenship and residence.
13.
Sanctions for Violations
Any breach of these terms results in immediate, permanent account termination, device lock ban, and forfeiture of unused credits, without refund.
14.
Cooperation with Competent Authorities
SearcherX cooperates with competent law enforcement agencies and judicial tribunals upon receipt of legally valid, binding subpoenas and court orders issued in accordance with due process.
15.
International Privacy Regulations (GDPR, UK GDPR, CCPA/CPRA)
Users located in the European Economic Area, the United Kingdom, or the State of California benefit from statutory privacy rights including data portability, restriction of processing, and "Do Not Sell My Information" protections.
16.
International Cybercrime Framework & Severability
This policy conforms to the Budapest Convention on Cybercrime. If any provision of this text is held invalid or unenforceable, remaining provisions shall continue in full force and effect.

Explicit Consent, Clarification and Acceptance Declaration

Die Verarbeitung stützt sich auf Vertragserfüllung (Art. 6 Abs. 1 lit. b DSGVO), berechtigte Sicherheitsinteressen (Art. 6 Abs. 1 lit. f DSGVO) und ausdrückliche Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).

Datenübermittlung und grenzüberschreitende Weitergabe
Personenbezogene Daten werden niemals verkauft, vermietet oder zu Werbezwecken weitergegeben. Server befinden sich in sicheren Rechenzentren mit Ende-zu-Ende-Verschlüsselung (TLS 1.3 / AES-256).

Aufbewahrungsfristen
Sitzungs- und Zugriffsprotokolle werden rollierend nach 30 Tagen gelöscht. Kontodaten bleiben bis zur Kontolöschung gespeichert (inklusive 24-Stunden-Sicherheitsfrist).

Rechte der betroffenen Personen (DSGVO Art. 15–22)
Betroffene haben das Recht auf Auskunft, Berichtigung, Löschung, Einschränkung der Verarbeitung, Datenübertragbarkeit und Widerspruch via [email protected].

WICHTIG: Die Plattform wird "wie besehen" bereitgestellt. Der Nutzer stellt SearcherX von sämtlichen Ansprüchen Dritter frei, die aus unbefugten Abfragen resultieren.

Örtliche Rechtskonformität
Der Nutzer ist selbst verantwortlich für die Einhaltung der in seinem Wohnsitzland geltenden Gesetze.

Sanktionen bei Verstößen
Zuwiderhandlungen führen zur sofortigen Kontosperrung, Gerätesperre und zum Verfall des Restguthabens.
14.
Zusammenarbeit mit Behörden
SearcherX kooperiert mit Strafverfolgungsbehörden im Rahmen rechtmäßiger gerichtlicher Anordnungen.
15.
Internationale Datenschutzbestimmungen (DSGVO & CCPA)
Es gelten die spezifischen Schutzrechte für Bürger der Europäischen Union und des Staates Kalifornien.

Cyberkriminalitätsabkommen & Salvatorische Klausel
Sollte eine Bestimmung unwirksam sein, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.

Цели обработки данных
Данные обрабатываются для аутентификации, поддержания стабильности инфраструктуры, предотвращения мошенничества и соблюдения правовых норм.

Сроки хранения данных
Журналы сессий и технические логи удаляются каждые 30 дней. Ключ и баланс сохраняются до удаления аккаунта.

Пользователь несет единоличную ответственность за соблюдение законов страны своего пребывания.

Санкции за нарушения
Нарушение правил влечет немедленную блокировку ключа доступа и привязанного устройства без права на возврат средств.

Взаимодействие с правоохранительными органами
Платформа соблюдает законные и надлежащим образом оформленные судебные предписания.

Киберпреступность и автономность положений

Nature Juridique du Service (Moteur de Recherche OSINT et Interface Modulaire)
SearcherX est un moteur technique d'indexation et de corrélation de renseignement en sources ouvertes (OSINT) facilitant la recherche d'informations publiques, de fuites de données historiques et de flux de cybermenaces.
La Plateforme intègre des modules de requêtes tels que Oathnet Lookup, Snusbase Lookup, IntelVault, Discord OSINT, Getcontact, WhatsApp / Fake No, OsintCat, Memory.lol, CraftRise OSINT, HackCheck, LeakOsint, OsintKit, etc.
- La Plateforme n'est pas le producteur, propriétaire ou hébergeur initial des données source.
- La Plateforme ne stocke pas les fuites de données de façon permanente ; elle agit comme un pont API rapide.
- Nous appliquons le principe de « Notification et Retrait » (Notice-and-Takedown) pour tout contenu illicite signalé à [email protected].
- L'usage est réservé aux audits légitimes de cybersécurité, à la vérification de ses propres données et à la recherche académique.

Données Personnelles Traitées et Architecture d'Accès Anonyme
SearcherX repose sur une collecte minimale de données :
- Clé d'accès persistante 256 bits (`X-****************`) : Aucun mot de passe, e-mail ou nom requis lors de l'inscription.
- Signature de verrouillage d'appareil (Device Lock) : Empreinte cryptographique liant la clé au terminal autorisé.
- Métadonnées de requêtes : Compteurs de requêtes, suivi des quotas et prévention des abus.
- Télémétrie de session : Adresse IP, chaîne agent utilisateur et horodatages.
- Données de paiement : Identifiants de transaction (TXID) pour les cryptomonnaies ou références bancaires.

Finalités du Traitement
Les données sont traitées uniquement pour fournir le service, sécuriser l'infrastructure contre les attaques DDoS et respecter les obligations légales.

Bases Légales du Traitement (KVKK Art. 5-6 & RGPD Art. 6)
Le traitement repose sur l'exécution du contrat de service, les intérêts légitimes de sécurité et le consentement explicite de l'utilisateur.

Transfert de Données et Partage Transfrontalier
SearcherX ne commercialise JAMAIS les données personnelles. Les serveurs sont hébergés dans des centres de données sécurisés conformes au RGPD (chiffrement TLS 1.3 / AES-256).

Durées de Conservation
Les journaux de session et historiques d'accès sont purgés selon un cycle glissant de 30 jours. Le solde et la clé sont conservés jusqu'à la suppression du compte.

Exclusion de Garantie et Indemnisation
IMPORTANT : Le service est fourni « EN L'ÉTAT ». L'utilisateur garantit et dégage de toute responsabilité SearcherX contre toute réclamation de tiers.

Conformité Juridique Locale
L'utilisateur est seul responsable du respect des lois applicables dans sa juridiction de résidence.
13.
Sanctions en Cas de Manquement
Toute violation entraîne la désactivation immédiate du compte et le verrouillage définitif sans remboursement.
14.
Coopération avec les Autorités Compétentes
SearcherX coopère avec les autorités judiciaires sur présentation de réquisitions légalement valides.
15.
Réglementations Internationales (RGPD & CCPA)
Les utilisateurs européens et californiens bénéficient des droits spécifiques conférés par leurs législations respectives.
16.
Cybercriminalité et Divisibilité des Clauses
Le texte est conforme à la Convention de Budapest. Si une clause est jugée invalide, les autres demeurent en vigueur.
17.
Déclaration de Consentement Explicite
